The boring bits, but good to know.

General


King Performance Ltd of First Floor, The Atrium, King Street, East Grinstead, RH19 3DJ bears responsibility for the following unless stated otherwise within these terms, descriptions for some phrases have been listed below;


  • Client/User – General public user who can enter the property for use of the facilities when authorised.


  • Member – A user who has paid a fee and signed up to a membership package for a specified duration


  • Membership – A contractual agreement for specified use of the facility including discounts, priority booking and other incentives.


  • Simulator Bay – One of 6 golf simulator bays located within the studio, for use up to 8 persons at any time.


  • Trackman – Radar technology controlled in all 6 simulator bays which is used to measure golf ball flight and tracking.


  • Coaching – Tuition provided in Kings Golf Studio by a specified coach, either under the King Performance brand or independently.

The Studio


The main studio consists of 5 main bays, a bar serving food and drink with access to three different rooms which are available to all clients/users from the general public.


A no running policy is in place throughout the venue and should be adhered to at all times.


Each simulator bay has a clear area laid out with astro turf and during operation only one player is permitted to stand within this area. King Performance LTD cannot be held responsible for injuries where these instructions have not been followed.


Toilets are checked and maintained as per the checklist within the toilet areas, all blockages or breakages to be reported to a member of staff if not noted already. Wet Floor signs will be placed in the correct areas along with signs stating if an area of the toilets are out of use.


All damages and spillages must be reported to a member of staff immediately, failure to do so and resulting injury cannot hold King Performance liable for the aforementioned.


Your safety and wellbeing is of paramount importance to us. In the interests of everyone’s enjoyment and safety, all members of your party are expected to behave responsibly throughout the duration of their visit to the venue.


Kings Management reserves the right to decline to honour a booking and/or eject from the premises any attendee who is seen to be drunk or under the influence of drugs; behaving in a violent, disruptive or irresponsible manner; causing a nuisance to others; or responsible for the commissioning of a criminal or civil offence.


All users must take responsibility for the placement and safekeeping of their personal belongings while present at the venue. King Performance cannot accept liability for any loss or damage to an individual’s possessions or personal belongings during their visit to the studio.


Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.


These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Bookings


Bookings can be made for use of the venue through three different methods; Phone, Walk-In and Online Booking.


In all cases, bookings are non-refundable unless suitable reasoning is deemed satisfactory by the management. Where an error has been made, clients are able to contact the venue immediately and have these rectified for no additional charge.


Cancellations with refunds may be accepted up until 21 days (3 weeks) before the time of the booking starting. If the cancellation is after this point, the booking can only be re-scheduled to replicate the existing booking at another time within 21 days of the original booking, subject to availability.


All bookings will be need to be paid in advance either over the phone or via our online booking system this does not apply for ‘walk in’ users.

Portable Entertainment


  1. Summary:

    1.1. Everything that we do, when it comes to your booking is all in our best efforts towards you looking back on the day and having nothing but good memories of us. It is, therefore, important to us that we are not confusing you with anything in these terms and conditions. Please do take your time to read through these Terms and Conditions entirely. There isn’t a huge amount, compared to some companies, but it’s still important to read through them so that we’re all on the same page, we all know what happens in certain situations and that you know exactly how we work and what to expect from us.

  2. Definitions:

    2.1. The ‘Client’ refers to you, your booking party, or

  3. Agreements and Contractual Obligations

    3.1. By hiring us, completing the booking form OR making initial payment towards hiring us, you enter into an agreement to have us arrive on your day and set up the products that you have paid for. You also agree that you will pay us in full in accordance with our payment terms and payment plan.

    3.2. As aforementioned, it is important to read these terms and make sure you are comfortable with them before you accept them. Refusal of terms will result in you being unable to book our services.

    3.3. You bear all responsibility when it comes to your guests being aware of the terms and conditions and accepting as well. By arriving at the venue and seeking to play on any of our booked activities, the guest(s) (or persons who did not hire us themselves and have not directly accepted the terms, but wishes to play) accept the terms.

    3.4. UK laws will always supersede these terms. We, the company, you, and all parties involved in the hiring process of our services agree to submit to any law that contradicts anything said and agreed to in these terms. All parties agree to submit to jurisdiction of courts only in this situation. Everything in these terms should be read and understood with the law in mind.

    3.5. These terms will stay the same as they were at the time of your booking. Whilst Kings Entertainment reserves the right to make amendments to these terms, any changes will only affect your booking if they have been agreed to in writing by both you and KING PERFORMANCE ltd.

  4. Financial agreements and Booking Payments

    4.1. You agree to pay the booking deposit, within 48 hours, in order to secure your date. The booking deposit is a non-refundable 20% of the total booking price. This amount will be put towards the final amount, with no amount deducted. To clarify, you will owe the remaining 80% of the total amount payable once you have paid the deposit (see section 5 on cancellations for precise details on monies owed in the event of cancellation). If you do not pay the booking deposit within 48 hours of booking, the date will be made available to be booked by other parties.

    4.2. You agree to make full payment no later than the dates/timeframes set out in our payment plan.

    4.3. You will be able to pay via BACS, card machine, or PayPal. Please be aware that in the event of fees occurring due to the method of payment, it is solely up to the discretion of The Company as to whether the client must pay extra in order to cover fees that incur a loss to The Company.

  5. Cancellation & Postponement Policies

    5.1. In the unfortunate event that you wish to cancel your booking with us, you may do so. The policies below outline the timeframes and the monies that may or may not be due in the event of cancellations.

    5.2. All cancellations, no matter the amount of time before the date you have booked us for, will be entitled to refund worth no more than a 80% of the total booking cost (this is in alignment with section 5.1, stating that the deposit of 20% is non-refundable. Please refer back to section 5.1 for further clarity)

    5.3. If you cancel more than 180 days in advance of the day you have booked us to provide our entertainment, you shall be entitled to a refund of any monies paid to The Company over the 20% deposit originally made to secure your booking.

    5.4. If you cancel less than 180 days in advance, but more than 90 days in advance of the date you have booked us for, you shall be entitled to a refund of any monies paid over 50% of the total booking cost.

    5.5. If you cancel less than 90 days in advance, but more than 30 days in advance of the date you have booked us for, you shall be entitled to a refund of any monies paid over 75% of the total booking cost.

    5.6. If you cancel less than 30 days in advance of the date you have booked us for, you shall not be entitled to any refund. This is because of the unlikelihood of The Company being able to accept a replacement booking for a date less than 30 days in advance.

    5.7. It will take no more than 14 days for The Company to process any agreed refunds, once agreed, to The Client. If you are due a refund, and you do not receive the due monies within 14 days of the agreement of refund taking place, it will be due to bank processing times or other reasons outside of our control. The Company will always issue refunds from our side within 14 days of agreement.

    5.8. Kings Entertainment understands that sometimes, the day you had originally hoped to have your event, needs to be changed. We can accommodate, but we do have some rules that will apply when the client wishes to postpone their event. The rules are outlined below:

    5.9. Force Majeure (see section 6 on ‘Force Majeure’ for more details) reasons are not qualifying reasons for postponement under the following guidelines. Only reasons other than Force Majeure will be considered for postponement, whether free or with a small fee being incurred. Reasons of postponement due to Force Majeure will be handled according to section 6.

    5.10. If the client wishes to postpone, and the date for re-booking is unavailable, then it will be considered as a cancellation and the above cancellation policy will apply.

    5.11. Postponement that is made after any increase of prices will result in an increased total booking fee. For example, if you have made your original booking on the 1
    st January and the cost of the booking is £2,000, you will have paid a deposit of £400 in order to secure the booking. Our general prices were, in this hypothetical example, increased on the 1st March of the same year, from £2,000 to £2,500. You contact us to postpone your booking on the 10th March, after our prices have changed. You may keep your original date for the price you have agreed to pay originally, or postpone, provided there is availability and it aligns with the cancellation policy, however you will be obliged to pay £500 to match the increase in price, as you have requested postponement after a price change.

    5.12. If the postponement is made more than 180 days in advance of your booking date, there will be no additional fees (other than any general price increases) incurred.

    5.13. If the postponement is made less than 90 days in advance, then cancellation policies will apply. You would be more than welcome, in that scenario, to re-book on a different date, but it would be classed as a new booking, at full price.

    5.14. The above postponement policy applies alone only on the first instance of postponement. Any further postponements will also incur a £75 admin fee which will be added to your booking price.

  6. Force Majeure

    6.1. Force Majeure relates to unforeseeable and unavoidable events that causes the expected agreements between parties to be unfulfillable. In this case, it is important as it could render us unable to carry out our services on the date you have booked us for. It is a French phrase that translates literally to ‘Superior Forces’, or as some call it, an ‘Act of God’. However, Force Majeure also relates to human activities/actions such as war or acts of terrorism.

    6.2. Force Majeure is a means of defence that was designed to free both parties of liability or obligation when duties are unable to be carried out.

    6.3. Examples of Force Majeure can include, but are not limited to: torrential rain, gale force winds, hurricanes, tornados, tsunamis, earthquakes, volcanic eruptions, snow (some cases might be manageable), extreme temperatures, actions of animals that make carrying out plans impossible or too unsafe, pandemics, floods, government or societal actions such as war (whether declared or not) or terrorism or civil unrest, infrastructure failure etc.

    6.4. In the event of cancellation due to a Force Majeure event, Kings Entertainment will work closely together with the client to come up with a solution. Hopefully, this will be postponement of the event. If postponement is not possible, or any other solution is not possible, both parties will be free from financial and contractual obligations.

  7. In the event of bad weather (but not to the extent of Force Majeure)

    7.1. As mentioned in our FAQ’s, we understand that whilst it’s meant to be your perfect day, Mother Nature doesn’t always co-operate. If this is the case, it’s a shame, but not all hope is lost! Read on for more information.

    7.2. If there is rain, we must protect the course. We will firstly try to move the course indoors if there is a threat of rain on the day. If, however, we have agreed to setup outside and there is no threat of rain, we will abandon the efforts to set up indoors. If, then, there is a threat of rain or rain starts to fall, we will be forced to set up gazebos. We will always have at hand enough gazebos which the staff onsite are able to set up at any time. These gazebos will cover the entirety of the course in order to protect it. Please be aware that if we deem it necessary to assemble the gazebos, you will be charged for the hire of them. The price will be in line with the prices at the time you made your booking. If we set up the gazebos due to the threat of rain, and it is then deemed unnecessary to use them, they will be dismantled and you will be refunded in full/the incurred charge will be dropped.

    7.3. In the event of rain that is not falling straight down (due to wind), in addition to the gazebo roofs, we will also setup side covers to the gazebos. These will be included in the fee for the gazebos.

    7.4. If the venue does not permit us to set up for reasons to do with ground conditions, it will be considered a cancellation and Kings Entertainment will not be held liable.

    7.5. If the ground outside is too wet for us to set up and we cannot inside, it will be considered a cancellation and Kings Entertainment will not be held liable.

    7.6. If we are unable to set up the gazebos, in order to protect the course from rain, due to space restrictions, it will be considered a cancellation and Kings Entertainment will not be held liable.

    7.7. Points 7.4, 7.5 and 7.6 will all be in effect so that there will result in no loss to the Company.

  8. Health & Safety and Refusing Play to Guests & Insurance

    8.1. At all times, Kings Entertainment reserves the right to refuse play to any guest or client if we deem it suitable. If, for example, the guest refuses to abide by health and safety rules, or is under the influence of alcohol, or they are behaving in any way that is deemed unsuitable or inappropriate, they are automatically deemed unsuitable to play and are expected to accept the decision of refusal made by Kings Entertainment, as they have accepted these terms and conditions here.

    8.2. Kids are allowed to play (who wants bored kids at a wedding), however we do say that anyone aged 16 or under must be supervised by an adult (it can’t be us) at all times whilst they play on the course or the simulator. Children are always the responsibility of their supervising adult.

    8.3. Any behaviour towards Kings Entertainment staff that is abusive, threatening or rude in any way, from the guests, clients, or even venue staff will, absolutely, not be tolerated and, at our discretion, result in our services being terminated straight away. This will also result in zero loss to Kings Entertainment. As written in point 3.3 on ‘Agreements and Contractual Obligations’, ‘You bear all responsibility when it comes to your guests being aware of the terms and conditions and accepting as well. By arriving at the venue and seeking to play on any of our booked activities, the guest(s) (or persons who did not hire us themselves and directly accept the terms, but wishes to play) accept the terms.’

    8.4. You will have access to our Risk Assessments and our Health and Safety Policy by hard copy on the day, and we are also able to send one to you if you request it, most often via email.

    8.5. We also have hard copies and electronic copies of our proof of public liability insurance, which is available upon request.

  9. Damages & Accidents

    9.1. Listen, we’re not crazy. Even though we’ve got a Crazy Golf course, it’s only the activities that might be Crazy… not us. We know that the course and other equipment will be subject to wear and tear during the general use of the products. However, bigger damages that require repairs or replacements is a slightly different story. Read below to find out more.

    9.2. Damages that result in a loss to Kings Entertainment, that are caused to our equipment (including, but not limited to, Crazy Golf Course, Trackman Simulator, vehicles, clubs, etc.), whether intentional or accidental, may well result in us seeking compensation. In that instance, the client agrees to pay compensation if, and when, Kings Entertainment requests it. We will always provide proof of cost, with pictures of damage and proof of invoices etc. from the supplier who will be carrying out repairs. This could be a total sum including materials and labour.

    9.3. We cannot and therefore do not accept any responsibility for any personal injuries, death, or other accidents when the clients or guests are using our services.

    9.4. We cannot and therefore do not accept any responsibility to damages to clients’ or guests’ personal possessions whilst using our services.

  10. Photography, Videography and Marketing

    10.1. At any time, we may feel it useful to us to take photos or videos of our services being used. By accepting these terms and conditions, you agree to us taking photos or videos that you may appear in to be used for our marketing purposes and business interests. We will never sell these photos or videos without prior written permission from the client or guests that appear in the images concerned. If you don’t agree to be on camera and for us to use these photos or videos for marketing purposes or business interests, please inform us in writing no later than 3 working days before the start of your event.

  11. Surface Requirements

    11.1. We can be amazingly flexible with the Crazy Golf, and there is still flexibility (albeit slightly less) with the Trackman Simulator, but the only thing we absolutely require is a flat surface. If we were to set up on even a slight slope, it would result in your ball either not rolling straight, or at worst, not even staying put where you place it! Some examples of where the activities can be set up would be grass, paving, patio, or gravel. Also, we do not use any pegs or stakes, so you and your venue don’t need to worry about our Crazy Golf course causing damage to the lovely lawn that you may have at your venue. It is up to you to ensure that your venue has the correct ground requirements in order for us to set up our activities. If we turn up to the venue, and there is no adequate ground for us to set up the activity or activities that you have booked, it will be considered a cancellation and will be at no loss to Kings Entertainment.

  12. Additional Time at the location, Access to the location and Additional Travel Costs.

    12.1. We will arrive at the venue with enough time for us to set up the course and the Trackman Simulator, if you have booked it. Depending on access to the venue and how far we have to carry the equipment, we may need to arrive earlier than standard in order to have the activities set up in time for the start of your booking.

    12.2. We will be travelling to the venue and transporting the equipment in a cargo van. It is up to the client to make sure that we have a place to park in order to unload the van safely. Ideally, we will be able to pull up next to the setup location, however we understand that this is not always possible. If we have to park outside the venue (if, for example, the venue does not have it’s own parking or there is not adequate parking), any fees we have to pay will be added on to the total booking price and charged to the client to refund to us.

    12.3.  We will travel for no additional cost within a radius of 40 miles from RH19 3DJ (our headquarters). Any additional miles will be charged to the client at £1 per mile, in order to cover wages and fuel. By accepting these terms and conditions, you agree to pay any excess fees that are incurred due to travel or access.

    12.4. If the venue charges the client more than expected due to our dismantling times or assembly times, this will not be charged back to Kings Entertainment. The Company will not accept any liability for such occurrences.

    12.5. In the event of late arrival due to Force Majeure (6.0), Kings Entertainment will not be held liable.

  13. Private and Personal information

    13.1. Any private and personal information you provide us with will only be used in the following ways:

  • Booking and Reservation: We will only use your personal information to process bookings and reservations for our services.

  • Communication: We will only use your contact information to communicate with you regarding your booking, including confirmation, updates, and any changes to the schedule.

  • Customer Support: We will only use your personal information to provide customer support, address inquiries, and resolve any issues or concerns you may have regarding our services.

  • Marketing and Promotions: With your consent, we will only use your personal information to send you promotional offers, newsletters, and updates about our products, services, and special events related to Kings Entertainment, and our services. We will never sell your information to third parties for marketing purposes.

  • Analytics and Improvement: We will only use your personal information to analyze and improve our services, tailor our offerings to better meet your needs, and enhance the overall customer experience.

  • Legal Compliance: We will only use your personal information as required by law or legal processes, including responding to lawful requests from government authorities or complying with applicable regulations.

  • Security: We will only use your personal information to protect the security and integrity of our services, prevent fraudulent activities, and ensure the safety of our customers and staff.

  • Feedback and Reviews: With your consent, we will only use your personal information to solicit feedback and reviews about your experience with Kings Entertainment and our services. We will never sell your information to third parties for this purpose.

  • Third-party Service Providers: We may share your personal information with trusted third-party service providers who assist us in providing our services, such as payment processors, marketing agencies, and logistics partners. However, we will never sell your information to third parties for any purpose.

  • Business Transactions: In the event of a merger, acquisition, or sale of assets, your personal information may be transferred to a third party as part of the transaction, subject to the terms of this Privacy Policy. However, we will ensure that your information remains protected and used only for the purposes outlined in this policy.

  • Aggregate Data: We may aggregate and anonymize your personal information for statistical analysis, research, and reporting purposes, without identifying you personally. We will never sell your personal information in aggregated or anonymized form.

  • Opt-out Options: You have the right to opt out of certain uses of your personal information, such as marketing communications, by following the instructions provided in our communications or contacting us directly. We will respect your preferences and ensure that your information is used only as you specify.


14. Course Rules

  • Walk only on the tee area and near the holes when playing Crazy Golf. Don’t stand on any other part of the hole.

  • If your ball is against the wall, skirting or prop on any part of the hole, move it the length of your putter head, in any direction, with no penalty.

  • You can take up to seven shots on each hole. If you reach seven shots and your ball isn't in the hole, mark a seven on your scorecard.

  • Stay away from anyone putting to avoid accidents. Make sure there's enough space around you for putting safely.

  • When you putt, keep your swing low, only as high as your shins.

  • Play the holes in order, starting from number one and going up to number nine.

  • Maximum of 6 players per group.


15. Recap and Small Print

15.1. Well, well, well. You’ve done well reading all of that! We know it’s a lot, but it’s a good thing that we’re all on the same page now. There are a few points below which recap a few of the super important bits in case you’ve forgotten! There are also a few more points added on – you know, crossing the t’s and dotting the i’s and all that stuff…


  • Booking Confirmation: The booking of Kings Entertainment's portable Crazy Golf course is confirmed upon receipt of a deposit or full payment, as specified in the booking agreement.

  • Cancellation Policy: Cancellations made within a specified timeframe may be subject to a cancellation fee or forfeiture of the deposit. Details of the cancellation policy are outlined in the booking agreement.

  • Liability Waiver: Kings Entertainment is not liable for any injuries, damages, or losses incurred during the use of the portable Crazy Golf course, except where prohibited by law. Participants may be required to sign a liability waiver before using the course.

  • Equipment Care: Users are responsible for the proper care and maintenance of the portable Crazy Golf course equipment while in their possession. Any damage caused by misuse or negligence may result in additional charges.

  • Indemnification: Users agree to indemnify and hold Kings Entertainment harmless from any claims, damages, or liabilities arising from their use of the portable Crazy Golf course, including but not limited to third-party claims.

  • Intellectual Property: All intellectual property rights associated with the Kings Entertainment brand and the portable Crazy Golf course, including trademarks, logos, and designs, are owned by Kings Entertainment. Unauthorized use or reproduction is prohibited.

  • Governing Law: These terms and conditions are governed by the laws of [Jurisdiction]. Any disputes arising from the interpretation or enforcement of these terms shall be resolved through arbitration or litigation in [Jurisdiction].

  • Severability: If any provision of these terms and conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • Modification: Kings Entertainment reserves the right to modify or update these terms and conditions at any time, without prior notice. Users are encouraged to review the terms periodically for any changes.


16.0 Footnote


By using the services provided by Kings Entertainment, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions outlined herein. These terms and conditions constitute a legally binding agreement between you and Kings Entertainment regarding the use of the services. You further agree to comply with all applicable laws, regulations, and guidelines related to the use of the services, including but not limited to any age restrictions or licensing requirements. If you do not agree with any part of these terms and conditions, you should refrain from using the services provided by Kings Entertainment. Kings Entertainment reserves the right to modify, update, or amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on the Kings Entertainment website or other relevant platforms. Your continued use of the services after any such modifications constitutes your acceptance of the revised terms and conditions. It is your responsibility to review the terms periodically for any updates or changes. If you have any questions or concerns regarding these terms and conditions, please contact Kings Entertainment for clarification before using the services.

Pricing and Payment


King Performance LTD operates three different pricing tiers for its simulator bays and putting area; Off-Peak, Peak and Prime.


These times are specified on all booking areas, website and around the studio. They are specified via day and time during the week and can be found here.


Simulator bays are priced by the hour and are suitable for up to 6 guests per bay.


The Putting Area is also priced by the hour and is suitable for up to 12 guests at any time.


Members are eligible for discounted bay rates as per their membership agreement, as our registered coaches who are also eligible for discounted bay rates as per their coaching agreement.


Payments are taken are taken via Cash, Card (Contactless payment/Chip and Pin from all major cards accepted including American Express), Google Pay and Apple Pay.

Admissions and Identification


King Performance LTD welcomes all ages to use the studio and its facilities. There are restrictions in place due to licensing laws and these have been listed below;


  • No under 18’s admitted within the bar area after 9pm every day.


  • No under 18’s admitted within the facility after 9pm every day unless accompanied by an adult over 21 to use all facilities except the bar area.



  • SIA licensed Door staff will patrol the entry and exit to the Studio on Friday and Saturday nights, these will be sourced from an external security company and all complaints or queries can be taken up with the appropriate companies on request. These staff are authorised to check bags or personnel in order to keep safety and security at its highest throughout the studio.

Food and Drink


King Performance LTD fully comply with the Challenge 25 Scheme and all staff will ask for identification should you be lucky enough to look under the age of 25.


If a member of staff believes they are not right to serve alcohol to an individual this decision is final and must be respected, failure to do so may result in ejection from the premises. Reasons for refusal of food or drink will not be limited to the Challenge 25 scheme, if a user appears to be under the influence of a large quantity of alcohol or becomes intimidating or abuse to staff this will not be tolerated.


All allergen and dietary requests must be made clear to a member of staff prior to ordering. There are signs within the menu clearly stating this.


Kings Kitchen operates on a basis where cross contamination is possible for example non-gluten or non-dairy may be prepared or cooked in an area where gluten and dairy foods are processed. Although every care is taken to prevent this, Kings cannot stop traces detections of said allergens being spread.

GDPR


Kings believes in security and protection for all of our clients and will never hold any user confidential data without consent. Kings will NEVER pass on or sell any information to 3rd party companies at ANY time.


Card details are disposed of securely and are never kept on computer databases or on site at any given time.


King Performance LTD work closely with our payment providers at Payment Sense and are fully PCI DSS Compliant for all card transactions.


King Performance LTD reserves the right to alter or change these Terms & Conditions at any given time and the above does not affect your statutory rights.
